Welcome to Raxta, a global real estate collaboration and marketing platform that connects agents, developers, investors, and individuals in individual or group transactions.
Access to and use of Raxta implies full acceptance of these Terms and Conditions of Use. Please read this document carefully before registering or using our services.
1. Purpose
These Terms and Conditions govern access to, registration with, participation in, and use of the Raxta platform (hereinafter, “the Platform” or “the Site”), available worldwide through the domain www.raxta.com and its local versions.
Raxta offers the following services:
Unlimited listing of real estate properties.
Interconnection between agents, agencies, buyers, and sellers.
Management of clients, leads, and shared transactions.
Tools for conducting group or collaborative sales.
Advertising spaces and membership services.
2. Registration and Membership
To participate in the Platform, users must register and subscribe to a monthly or annual plan, the cost of which will be determined by the plan in effect in their country.
Membership grants:
Access to unlimited management and publishing tools.
Participation in shared client programs or group sales.
Priority visibility within the network of agents and projects.
Registration implies acceptance of the confidentiality policies, dispute resolution policy, and other related documents.
3. Listing Posts
Users may post unlimited real estate listings, provided they meet the following requirements:
Properties must be real, available, and up-to-date.
Published information must be truthful, accurate, and verifiable.
The portal may not be used for duplicate, false, or fraudulent listings.
Raxta may review, suspend, or remove listings that do not meet these conditions or that violate the laws in force in the corresponding country.
4. Commissions and Group Transactions
All properties listed on Raxta must be available to share commissions with other agents, users, or clients provided by the platform.
If a sale or rental is completed with a client provided directly by Raxta, the platform will receive a commission of 1% of the sale price, or the equivalent of 50% of the monthly membership fee for rental transactions.
When the transaction is carried out between partner members of the platform, Raxta will not charge an additional commission.
In group or delegated sales, users must respect the commission previously agreed upon or declared at the time of client or property registration.
Failure to comply with these rules may result in penalties, account suspension, or loss of benefits.
5. Proper Use of the Platform
The user agrees to:
Use Raxta only for legitimate real estate purposes.
Refrain from engaging in illegal, defamatory, fraudulent, or unfair competition activities.
Do not access other users' information or data without authorization.
Do not publish offensive, misleading, or immoral or illegal content.
Raxta may suspend or delete any account that violates these conditions without prior notice.
6. User Responsibility
The user is responsible for all information they publish, as well as for any transactions, messages, or agreements that arise on or off the platform as a result of using its tools.
Raxta acts solely as a technological intermediary, without directly intervening in the negotiation, closing, or execution of real estate transactions between users, except in cases where it has been the client's direct supplier.
7. Raxta's Responsibility
Raxta does not guarantee:
The accuracy or permanent availability of listings.
The success or closing of real estate transactions.
The solvency or veracity of registered users.
However, Raxta will apply reasonable controls to ensure the authenticity of participants and compliance with quality standards.
The platform may temporarily interrupt its services for maintenance, updates, or force majeure events without giving rise to any right to claim or compensation.
8. Confidentiality and Data Protection
Raxta respects user privacy and protects personal information in accordance with its Privacy Policy, which forms an integral part of these Terms and Conditions.
All personal or business information will be treated with strict confidentiality and used only for the stated purposes.
9. Intellectual Property
All content, design, logos, software, and structure of the Raxta portal are the exclusive property of the company that owns the Raxta brand and are protected by international intellectual property laws.
It is prohibited to reproduce, copy, or use any part of the site without express written authorization.
10. Payments and Billing
Membership and subscription services are paid for through the payment methods available in each country.
Amounts are expressed in local currency or US dollars, depending on the region.
Raxta may update the prices or terms of its services after notifying the user.
Payments are non-refundable except as otherwise provided by law or in the case of an error attributable to the platform.
11. Sanctions and Suspension
Raxta may temporarily or permanently suspend an account when:
The user violates these terms or publishes false information.
Fraud, misuse, or attempted manipulation of the system is detected.
There is repeated failure to update listings or non-payment of membership fees.
In such cases, Raxta may apply financial penalties or prevent account reactivation.
12. Jurisdiction and Applicable Law
Raxta operates globally.
In the event of a dispute, the applicable law will be that of the user's country of residence, or failing that, that of Raxta's administrative headquarters (United States), unless otherwise required by mandatory provisions.
The parties will always seek an amicable or mediated resolution, in accordance with the mechanisms established in the Consumer Mediation and International Dispute Resolution section.
13. Modifications
Raxta may modify these Terms and Conditions at any time, notifying users by email or posting on the portal.
Continued use of the Platform after such modifications will constitute acceptance of the new terms.
